UK Infant Abandonment Legal Framework

Understanding the law is essential for safe operation. BABY-i works within these boundaries, never outside them.

  Statutory Definition?

NO. There is no comprehensive statutory definition of infant abandonment in UK law, and instead determination is by reliance on case law and safeguarding guidance. 

  Charity Custody Authority?

NO. Only Police and Local Authorities have legal custody powers. NSPCC is the ONLY charity with "authorised person" status.

  Anonymous Surrender?

NO. The UK has no Safe Haven law. Unattended placement = potential abandonment. 

 LA Accommodation Duty?

YES. Local Authorities MUST accommodate children who are "lost or abandoned" under Section 20(1)(c). 

  Strategy Meeting Deadline?

YES. This must be held within 48 hours of an abandoned baby's discovery.

  Police Protection Duration?

YES. Police can protect a child for up to 72 hours under Section 46, Children Act 1989.
